Assault is defined as the willful intent of one person to inflict a violent injury on another person. Battery is the physical violence actually committed against another person. Assault and battery carries up to 30 days in jail.

Assault and battery of a high and aggravated nature (ABHAN) is defined as an unlawful act of violent injury to another person, accompanied by circumstances of aggravation. The focus is not on whether bodily injury was inflicted on the victim, but on whether any circumstances of aggravation existed. Circumstances of aggravation may include the infliction of serious bodily injury, the use of a deadly weapon, the intent to commit a felony, great disparity in the ages or physical condition of the parties, differences in sexes, the purposeful infliction of shame and disgrace, taking indecent liberties or familiarities with a female, or resisting lawful authority. ABHAN is a common law offense classified as a misdemeanor. This offense carries up to 10 years in prison.

Assault and battery with intent to kill is a felony and is defined as an unlawful act of a violent nature to another person with malicious intent. The requisite malice may be found from an intent to do serious bodily harm, from the use of a deadly weapon, from a depraved or malignant heart, or even from the commission of a felony. ABWIK carries up to 20 years in prison. This type offense may be considered a violent crime and requires an experienced lawyer
