Degrees of Murder
There are three different degrees of homicide in South Carolina.
- Murder – Murder is the killing of another person with malice aforethought. The sentence for murder in South Carolina is death, life imprisonment or a minimum prison term of 30 years, depending on the circumstances surrounding the case.
- Voluntary Manslaughter – Voluntary manslaughter is the unlawful killing of a human being in sudden heat of passion upon sufficient legal provocation. A person convicted of manslaughter, or the unlawful killing of another without malice, may be imprisoned for up to 30 years.
- Involuntary Manslaughter – Involuntary manslaughter is: 1) the unintentional killing of another without malice, but while engaged in an unlawful activity not naturally tending to cause death or great bodily harm; or 2) the unintentional killing of another without malice, while engaged in a lawful activity with reckless disregard for the safety of others. A person convicted of involuntary manslaughter faces a prison term of up to five years.
